Terms of Service

These Terms govern your use of LandWorkPro's website, email list, and software. We have tried to keep this in plain English. If something does not make sense, email us at carson@landworkpro.com.
1. Who we are
LandWorkPro is a product of LANDWORKPRO, LLC, a Tennessee limited liability company headquartered in Murfreesboro, Tennessee (“LandWorkPro,” “we,” “us,” or “our”). When we say “you,” we mean the person or business using our website, our email list, or the LandWorkPro software.
2. What the service is
LandWorkPro is bidding and payment software built specifically for operators in six trades: forestry mulching, land clearing, excavation, tree service, brush hogging, and demolition. Fire Mitigation Mode is included for defensible space, fuel reduction, and insurance-discount work.
LandWorkPro launched on July 19, 2026 and is available to everyone today. All six trades are supported, with no modules held back.
We make no guarantee that the service will include any specific feature described on this site, or that it will be priced exactly as described on this site.
3. Eligibility and account responsibility
You must be at least 18 years old and legally able to enter a contract in your jurisdiction to use the service. If you create an account on behalf of a business, you confirm you have the authority to bind that business to these Terms.
You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us promptly at carson@landworkpro.com if you believe your account has been compromised.
4. Email list
LandWorkPro is open to everyone, so there is no longer a waitlist. If you previously joined our waitlist or email list, we use the information you submitted (your name, email, and trade) to contact you about LandWorkPro and nothing else. Being on that list does not create a contract to buy the product, and it does not guarantee a spot in the founder offer.
5. Founder offer
The first 100 operators to start a Pro subscription receive founder pricing: $49 per month for their first 12 months, after which the subscription renews at the then-current standard Pro rate. The founder price applies to the Pro monthly subscription only and is limited to the first 100 operators, subject to availability.
- How it applies. The founder price is applied as a recurring discount to the Pro subscription for the first 12 billing months. There is no deposit and no separate reservation.
- After 12 months. Once the 12-month founder period ends, the subscription renews at the standard Pro rate in effect at that time. Upgrades to higher tiers, add-on features, and usage-based charges are priced at the then-current rates.
- Cancellation. You may cancel anytime. If you cancel and later resubscribe, the founder price does not reinstate.
6. Subscription, fees, and billing
LandWorkPro is offered as a monthly subscription. Specific pricing tiers and features are described on our pricing page or your order form at the time you subscribe.
- Billing. You authorize us (through our payment processor, Stripe) to charge your payment method on a recurring basis at the interval you selected, until you cancel.
- Platform fees. Stripe payments processed through LandWorkPro on behalf of your customers carry a platform fee of 0.5% (Pro plan) or 1.5% (Starter plan), deducted from the settlement amount. Cash, check, and off-platform payments are not subject to platform fees.
- First Month Guarantee and Refunds. New customers may request a full refund of their first subscription payment within 30 days of the date of that first payment by contacting LandWorkPro support or replying to any LandWorkPro email. The guarantee applies one time per customer, to the first subscription payment only. Customers who cancel and later re-subscribe, or who upgrade or change plans, are not eligible for an additional guarantee. Refunds are issued to the original payment method and typically appear within 5 to 10 business days.
- Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will not be charged again. Except for the First Month Guarantee described above, payments are non-refundable, and no partial or prorated refunds are provided for unused time.
- Failed payments. If a payment fails, we will notify you and provide a grace period (typically 7 days) to update your payment method. During the grace period, you can view your data but cannot create new bids, send estimates, or process payments. If payment is not resolved after the grace period, your account may be suspended. Your data is preserved and accessible for export for a reasonable period after suspension.
- Taxes. Prices are exclusive of any taxes, levies, or duties imposed by your jurisdiction, which you are responsible for.
7. Payments: Stripe Connect
LandWorkPro uses Stripe Connect to enable you to accept payments from your customers. This section describes how payment processing works.
7.1 Stripe Connect onboarding
When you set up payments in LandWorkPro, you complete Stripe's hosted onboarding flow. This connects your business bank account to receive payouts. You do not need a separate Stripe account. Stripe handles identity verification (KYC), bank account linking, and compliance. By completing Stripe onboarding, you agree to Stripe's Connected Account Agreement and Stripe's Services Agreement, in addition to these Terms.
7.2 How customer payments work
When your customer pays through a LandWorkPro estimate or invoice link, the payment is processed by Stripe. Your customer can pay by:
- Credit or debit card.Standard Stripe processing fees apply (currently 2.9% + $0.30 per transaction, subject to Stripe's then-current pricing).
- Bank transfer.If you have bank transfers enabled, your customer can pay directly from their bank account. Stripe processing fees for bank transfers are currently 0.8% of the transaction amount, capped at $5.00 per transaction (subject to Stripe's then-current pricing).
Processing fees are deducted from the payment amount before settlement to your bank account. LandWorkPro does not set or control Stripe's processing fees.
7.3 Platform fee
LandWorkPro charges a platform fee on payments processed through the service. The platform fee is a percentage of each transaction amount, as specified in your subscription tier. The current platform fee rate is disclosed on your pricing page and in your account settings. The platform fee is collected by Stripe as an application fee and deducted from each transaction before the remaining funds are settled to your bank account.
The platform fee applies only to payments processed through LandWorkPro via Stripe. No platform fee is charged on payments you receive outside of the app (cash, checks, Venmo, Zelle, or other methods you record manually).
7.4 Bank transfer authorization and risks
When your customer pays by bank transfer, Stripe collects the customer's bank account information and authorization directly. LandWorkPro does not see or store your customer's full bank account or routing numbers.
Important: Bank transfers settle on a different timeline than card payments. Bank transfers typically take 4 to 5 business days to settle. During this period, the payment may appear as pending.
Bank transfer returns. A bank transfer can be returned (reversed) after it initially appears successful. Common reasons include insufficient funds, a closed account, or a customer dispute. If a bank transfer payment is returned:
- Stripe will reverse the payment and debit the returned amount from your connected bank account or offset it against future payouts.
- LandWorkPro will notify you of the return and update the payment status in your account.
- You are responsible for any work performed or costs incurred before the return. LandWorkPro does not guarantee or insure bank transfer payments. The risk of non-payment due to bank transfer returns rests with you, the operator.
- Any platform fee previously collected on the returned payment will be refunded to you.
7.5 Payouts
Funds from customer payments (minus Stripe processing fees and the LandWorkPro platform fee) are settled to the bank account you linked during Stripe Connect onboarding. Payout timing follows Stripe's standard schedule (typically 2 business days for card payments, 4 to 5 business days for bank transfer payments). LandWorkPro does not hold or control your funds; Stripe handles all fund movement.
7.6 Off-platform payment recording
You can record payments received outside of LandWorkPro (cash, checks, Venmo, Zelle, CashApp, wire transfers, or other methods) for your own bookkeeping and job tracking. These records are stored in your account for reporting purposes only. LandWorkPro does not process, verify, or guarantee off-platform payments, and no platform fee is charged on them.
8. Consumer financing
LandWorkPro integrates with third-party consumer financing providers (such as Wisetack, Acorn Finance, or Hearth) to offer your customers financing options on their jobs. When a customer applies for financing:
- The financing application is handled entirely by the financing provider. LandWorkPro does not make lending decisions, access credit reports, or handle the customer's financial application data.
- If approved, the financing provider pays you (the operator) directly, according to that provider's terms and payout schedule.
- LandWorkPro may earn a referral fee from the financing provider for each funded transaction. This fee is paid by the financing provider, not by you or your customer.
- You are responsible for understanding and complying with the terms of any financing provider you use. LandWorkPro does not guarantee financing approval, funding timelines, or the acts or omissions of any financing provider.
9. Your content and data
You own everything you put into LandWorkPro: your customer lists, your bids, your job records, your photos, your pricing inputs, and your voice recordings used for bid creation. We claim no ownership of that content. You grant us a limited license to host, store, process, and display it as necessary to provide the service to you.
We will never sell or share your customer-level data. Your customers' names, contact information, and addresses, and your individual bids and rates, are yours. No other operator and no outside company will ever see them.
Separately, we may use, share, and license aggregated and anonymized data. That means information combined across many operators and stripped of anything that could identify you, your business, or your customers. We use it to operate and improve the service, to build the operator benchmarks and insights inside the product, and to work with outside partners on research and analysis about the land trades.
This is how the benchmarks work. The cost and pricing ranges you see in LandWorkPro come from this pooled, anonymized data, and your business is one of the contributors to it. No operator can see another operator's individual bids, rates, or customer information. Aggregate figures are only shown once enough businesses are in a group that no single one of them could be identified.
10. AI-powered features
LandWorkPro includes AI-powered features such as Voice-to-Bid (drafting bids from voice input), bid suggestions based on your historical data, and AI Insights. These features are provided as tools to assist your decision-making. They are not a substitute for your professional judgment.
- Voice-to-Bid processes your voice input through third-party AI service providers. Audio is processed in real time and is not permanently stored after bid fields are populated. You should review all AI-generated bid fields before sending any estimate to a customer.
- Bid suggestions and AI Insights are generated from your own job history and, at higher tiers, from anonymized network data. These are estimates and suggestions, not guarantees of accuracy or profitability.
- LandWorkPro does not guarantee the accuracy of any AI-generated output. You are responsible for reviewing and approving all bids, estimates, and pricing before sending them to your customers. Pricing decisions, scope decisions, and all other business decisions are yours alone.
11. Acceptable use
By using the service, you agree not to:
- Use LandWorkPro to send spam, illegal content, or content that infringes someone else's rights.
- Attempt to break into other accounts, or interfere with how the service works for other operators.
- Upload malicious code or place an unreasonable load on our infrastructure.
- Use the payment processing features for transactions unrelated to the land trades services you provide through the normal course of your business.
- Intentionally manipulate or falsify off-platform payment records, job data, or other information to misrepresent your business activity.
We can suspend or terminate accounts that violate these rules. For clear, ongoing abuse we may do so without prior notice.
12. Our intellectual property
The LandWorkPro brand, logo, software, designs, copy, and underlying codebase are owned by LandWorkPro, LLC. We grant you a non-exclusive, non-transferable license to use the service for your business while your subscription is active. That license ends if your subscription ends.
13. Restrictions on Use
You will not, and will not permit any third party to:
- (a) copy, reproduce, republish, distribute, display, or create derivative works of the Service, including its software, user interface, designs, layouts, workflows, text, or graphics, except as needed for your own internal business use of the Service;
- (b) reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying ideas, algorithms, or structure of the Service, except where this restriction is prohibited by applicable law;
- (c) access or use the Service to build, train, or improve a competing or similar product or service, or for competitive analysis or benchmarking, whether directly or on behalf of a competitor;
- (d) use any robot, spider, scraper, crawler, or other automated means to access, monitor, extract, or copy any content or data from the Service, or circumvent any rate limits, access controls, or technological protection measures;
- (e) resell, sublicense, rent, lease, or otherwise make the Service available to any third party except as expressly authorized; or
- (f) remove, obscure, or alter any proprietary or copyright notices on the Service.
14. Ownership
The Service, including all software, designs, interfaces, workflows, text, graphics, logos, and other materials, and all intellectual property rights therein, are and remain the exclusive property of LandWorkPro and its licensors. You receive only a limited right to use the Service under these Terms; no other rights are granted.
15. Enforcement
We may investigate suspected violations and suspend or terminate, without notice or refund, any account we reasonably believe is used for scraping, reverse engineering, competitive intelligence, or any other prohibited purpose.
16. SMS and email notifications
With your consent, LandWorkPro may send transactional SMS messages and email notifications related to your bids, jobs, payments, and account. Standard message and data rates from your carrier may apply. You can reply STOP to any SMS to opt out, or change notification settings from within your account.
17. Third-party services
LandWorkPro relies on third-party services to operate. By using the service you understand that information may pass through these providers, including:
- Stripe for payment processing, Stripe Connect, and customer payment acceptance.
- Wisetack, Acorn Finance, Hearth (or other financing partners as added) for consumer financing.
- Third-party AI service providers for AI-powered voice processing and bid assistance.
- A third-party SMS and communications provider for SMS and voice notifications.
- A third-party email service provider for transactional and marketing email.
- Third-party hosting and infrastructure providers for hosting, database, and content delivery.
Each of these providers has its own terms and privacy policy. We require them to handle your data securely, but we are not responsible for their independent acts or omissions.
18. Service availability
We strive to keep LandWorkPro available, but we do not guarantee uninterrupted access. We may take the service down for maintenance, upgrades, or emergencies. We will give reasonable notice for planned downtime when we can. LandWorkPro is not liable for any losses caused by service unavailability, including missed bids or delayed payments.
19. Termination
You can stop using LandWorkPro at any time by cancelling your subscription. We can terminate or suspend your access if you breach these Terms, if your payment fails and is not resolved after the grace period, or if we are required to do so by law.
On termination:
- Your subscription ends at the close of your current paid period.
- You can export your data (job records, customer lists, payment history) for 30 days after termination.
- Stripe Connect remains active for any pending payouts. You may also disconnect your Stripe Connect account independently through Stripe.
- Any outstanding platform fees owed to LandWorkPro remain due.
20. Disclaimers
LandWorkPro is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be error-free or uninterrupted.
- Pricing recommendations, AI-generated bid suggestions, or AI Insights will be accurate or profitable.
- Any specific business outcome will result from using the software.
- Payments processed through Stripe (including bank transfers) will be successful, timely, or free from returns or chargebacks.
- Financing applications submitted through integrated financing partners will be approved.
Operating decisions, pricing decisions, and the decision to begin work before payment clears are yours alone.
21. Limitation of liability
To the maximum extent permitted by law, LandWorkPro, LLC and its owners, members, employees, and affiliates will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost bids, failed payments, bank transfer returns, financing denials, or business interruption, arising out of or related to these Terms or the service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or related to these Terms or the service is capped at the greater of $100 or the total subscription fees you paid to LandWorkPro in the twelve (12) months before the event giving rise to the claim. This cap does not include funds owed to you from customer payments processed through Stripe, which are governed by Stripe's terms.
22. Indemnification
You agree to defend and indemnify LandWorkPro, LLC against claims, damages, losses, and expenses (including reasonable legal fees) brought by third parties (including your own customers) arising out of:
- Your use of the service.
- Your content, bids, estimates, or pricing decisions.
- Your breach of these Terms.
- Any dispute between you and your customer regarding work performed, payment terms, or job scope.
- Any bank transfer return, chargeback, or payment dispute involving your customers.
We will handle our own legal costs in defending the LandWorkPro brand and software against claims unrelated to your specific use.
23. Dispute resolution
20.1 Informal resolution first
Before filing any formal legal action, you agree to contact us at carson@landworkpro.com and describe the dispute. We will attempt to resolve it informally within 30 days. Most concerns can be resolved quickly through direct communication.
20.2 Governing law and jurisdiction
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. If informal resolution does not succeed, you and LandWorkPro agree that any dispute arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in Rutherford County, Tennessee, and you consent to the personal jurisdiction of those courts.
24. General provisions
21.1 Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
21.2 Entire agreement
These Terms, together with the Privacy Policy and any order form or pricing page you agree to at signup, constitute the entire agreement between you and LandWorkPro regarding the service. They supersede any prior agreements, representations, or understandings.
21.3 No waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or our right to enforce it later.
21.4 Assignment
You may not assign or transfer your account or these Terms without our written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
21.5 Force majeure
LandWorkPro is not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, power outages, internet service disruptions, acts of government, pandemics, or failures of third-party service providers (including Stripe, Twilio, or hosting providers).
25. Changes to these Terms
We may update these Terms from time to time as the product evolves. If we make material changes, we will let you know by email or an in-product notice at least 15 days before the change takes effect. Continuing to use the service after a change means you accept the new Terms. If you do not accept, you can cancel.
